Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of mhbadigital.com and to the digital marketing and website design services provided by MHBA Digital (“we”, “us”, “our”). By using our website or hiring us, you (“the client”, “you”) agree to these Terms. A signed proposal or agreement for a specific project takes priority over these Terms where they differ.

1. Our services

We provide digital marketing services (including Meta Ads, Google Ads, SEO, social media, content, email marketing and tracking) and WordPress website design, development and maintenance. The exact scope, deliverables, timeline and price for each project are set out in the proposal or quotation we send you.

2. Quotes and payment

• Prices are quoted in BDT for clients in Bangladesh and in USD for international clients, unless agreed otherwise.
• Website projects normally require an advance payment before work starts, with the balance due before launch or handover, as stated in the proposal.
• Monthly marketing services are billed in advance for each month.
• Late payments may pause work until the account is settled.

3. Advertising spend

Advertising budgets (for example Meta or Google ad spend) are separate from our fees and are paid by the client directly to the advertising platform, unless we agree otherwise in writing. You are responsible for keeping a valid payment method on your ad accounts.

4. Your responsibilities

• Provide accurate information, content, images and approvals on time.
• Give us the access we need to your ad accounts, website, hosting and analytics.
• Make sure the products, services and content you ask us to promote are legal and that you have the rights to any materials you give us.
• Follow the policies of the platforms we advertise on.

Delays in providing content or approvals may delay timelines.

5. Results

We use our experience and best practice to improve your results, but advertising and search performance depend on many factors outside our control, such as platform algorithms, competition, budget, product and pricing. We do not guarantee specific results, rankings, sales or return on ad spend.

6. Revisions and changes

Website projects include the number of revision rounds stated in the proposal. Work outside the agreed scope will be quoted separately before we start.

7. Ownership

• Once paid in full, you own the final website, designs and content we create specifically for you.
• Your ad accounts, domain, hosting and data remain in your name and under your control.
• Third-party themes, plugins, fonts and stock images remain subject to their own licences.
• We may show the work in our portfolio and case studies unless you ask us not to in writing.

8. Confidentiality

We keep your business information, account access and data confidential and use them only to deliver our services.

9. Cancellation

• Monthly marketing services can be cancelled by either party with 30 days written notice, unless a different minimum term is agreed in the proposal.
• Advance payments for work already started are non-refundable.
• If a website project is cancelled, you pay for the work completed up to the cancellation date.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or problems caused by third-party platforms, hosting providers, plugins, or account restrictions applied by advertising platforms. Our total liability for any claim is limited to the fees you paid us for the service in question during the previous three months.

11. Website use

The content on mhbadigital.com is provided for general information. You may not copy or reuse our website content, designs or logos without permission.

12. Governing law

These Terms are governed by the laws of Bangladesh. Any disputes will be handled by the courts of Dhaka, Bangladesh, after we have first tried to resolve them in good faith.

13. Changes to these Terms

We may update these Terms from time to time. The latest version will always be on this page.
